CCI claims that Meta is gaining extra benefits from the digital market due to its prominence. The Competition Commission of India also ordered WhatsApp to explain why it shares data with other companies.

The selected tribunal will decide whether to give the temporary relief to WhatsApp while the hearing is reviewed.The NCLAT has agreed to hear the case from Meta and WhatsApp. Meta is also the owner of Facebook. This petition challenged the decision of the Competition Commission of India which imposed a penalty of 213.14 Crore.

The basic reason for this penalty is that the Competition Commission of India accused Meta of misuse of its power in the market. After listening to the initial matter from the Commission Competition of India and Meta on this prominent problem, the Nation Company Law Appellate Tribunal members decided that this matter requires more consideration and arguments.

The NCLAT accepts WhatsApp’s appeal and its bench, inculding with Justice Ashok Bhushan mentioned that this submission placed through both parties is important therefore it needs to be listened to carefully and attention. The Bunch has agreed to hear and consider both appeals filled by Meta-Owner WhatsApp. 

The National Company Law Appellate Tribunal has not decided whether it temporarily ban the Competition Commission of India order against the Meta-owned WhatsApp platform. The bench decided that they would take a stronge decision next week.

During the case hearing,  the lawyer on the side of WhatsApp tries to agree with the tribunal to stop the CCI’s order until the case continues. Lawyers of CCI asked if the request was opposite to authorizing the stay order.

On 18 November, the Commission Competiton of India fined Rs 213.14 crore on social media particularly Meta for adopting the wrong business method for the WhatsApp privacy policy 2021.

The Competition Commission of India has said the WhatsApp and Meta to immediately stop these anti-competitive practices that damage the competition in the digital market and also ordered Meta to change to bring some names of behavioral remedies within the given time. These developments directly relate to set problems in competition.

The CCI ordered the Meta-owned WhatsApp to instantly stop sharing user data with other companies just for advertisements for the coming five years. 

Furthermore, the Competition Commission of India asked Meta not to force users to share their data using WhatsApp. Meta should facilitate the users to use WhatsApp without sharing their data.
